An Act to Amend Section 2, 7 and 14 of an Act Entitled "An Act to Establish a Normal and Industrial College in the State of South Carolina for the Education of White Girls," Approved December 23rd, A.D. 1891, so as to Provide for the Election and Terms of Local Trustees and to Authorize the State to Incur Certain Expenses.

Section 1. Be it enacted by the Senate and House of Representatives of the State of South Carolina, now met and sitting in General Assembly, and by the authority of the same, That Section 2 of an Act entitled "An Act to establish a Normal and Industrial College in the State of South Carolina for the education of white girls," approved December 23rd, A. D. 1891, be amended by inserting between the figures "1893" and the words ''in all cases," in said Section 2, page 1103 of the printed Act the following: "and who shall thereafter be elected by the Board of Trustees and hold office for two and four years respectively, to be determined by lot between them as to which shall hold the long term." So that said Section 2 when thus amended shall read as follows:

"Section 2. That the institution shall be managed by a Board of Trustees, composed of the Governor of the State and the State Superintendent of Education and the Chairman of the Committees on Education of the Senate and House of Representatives, who shall be members ex officio, and nine others, seven to be elected by the Legislature and two by the Board of Trustees as hereinafter provided. The regular terms of office of the elected members shall be six years, but the first seven elected shall serve, —2 for 2 years, 2 for 4 years and 3 for 6 years, these terms to be determined by lot after election. The terms of office of the elected members shall date from the first day of January next after their election, and the Legislature shall hold an election every two years to fill vacancies as they may occur by the expiration of the terms of office: Provided, That after the location of said institution has been determined on by the Board of Trustees above provided for, said Board of Trustees shall be increased by two additional members, who shall reside at or near the place where the institution is located, said two additional members to be elected by the Board of Trustees and to hold office for two years and four years respectively, and who when elected shall determine by lot between them as to which shall hold the long term. In all cases where there is a vacancy in the Board of Trustees the Governor shall be empowered to fill it by appointment until the next session of the Legislature. The Board of Trustees shall report before the meeting of each General Assembly to the Governor the conditions, needs and operations of the institution."

Sec. 2. That Section 7 of said Act be amended by striking out the proviso at the end of said Section 7, so that said Section as thus amended shall read as follows:

"Section 7. That the said Board of Trustees, as soon as practicable after their organization, shall proceed to select a location for the South Carolina Industrial and Winthrop Normal College. In the selection of the location the Trustees shall look to the convenience of the people of every section of the State; they shall take into consideration the advantages and disadvantages of the different offers, in money and sites, made for the location of the institution, and shall locate it at the place which offers the most advantages. They shall see that the bids for the location of the institution are fully secured, and shall give notice for thirty days in three newspapers published in this State before finally locating said institution. When the site is selected they shall, as soon as possible, erect suitable building for said institution and procure and place in the same the necessary machinery, power, fixtures, furniture, equipment, appliances and apparatus to carry into effect the intention of this Act."

Sec. 3. That Section 14 of said Act be amended by striking out the proviso at the end of said Section 14. So that said Section 14 when thus amended shall read as follows:

"Section 14. That the Trustees of the said South Carolina Industrial and Winthrop Normal College be authorized to make a requisition on the Superintendent and Board of Directors of the State Penitentiary for as many as one hundred able-bodied convicts, if so many be required, for the purpose of working them in the erection (of buildings) for said college, and the said Superintendent and Board of Directors of the Penitentiary are hereby required to furnish the number of convicts so requested, if on hand in the Penitentiary."

Section 15. That said Act be, and the same is hereby, amended by striking out the words "The South Carolina Industrial and Winthrop Normal College" wherever the same occurs in the said Act and inserting in lieu thereof the words "the Winthrop Normal and Industrial College of South Carolina;" so that the said college shall be known and called hereafter " The Winthrop Normal and Industrial College of South Carolina." And that the change of name of said institution as herein set forth shall in no wise invalidate any securities issued in aid of the same.

And that Section 15 be changed to Section 16.
